SACVEN’s forty-sixth Anniversary
 
 
 
 
The Cámara Venezolana de Productores Fonográficos, the Asociación de Productores Fonográficos y Videográficos de Venezuela (Aprofon), the Cámara Venezolana de la Industria Radiodifusora , Directv, Venevision, Televen and Ateneo de Caracas signed agreements with Sacven that authorize them to reproduce and communicate, depending on the case, the work pieces of their members or represented people.

These agreements, signed with those companies representatives, will allow Sacven to control work pieces use, as well as collect the economic benefits that may be generated by their exploitation on time.

The following are some of the commitments made by the involved parts:

Cámara Venezolana de Productores Fonográficos and Aprofon:
This agreement implies that the phonographic producers will pay a fee that goes from seven to seven point five per cent of the neat price that they give to the wholesale distributor to Sacven. This payment will be done for the concept of fixation, reproduction and distribution of the repertoire of the society in conventional supports (vinyl records, compact discs, mini disc and cassette).

Among other clauses, phonographic producers are obliged to include in every print of phonographic work, the theme tittles and the original authors’ names, as well as the editors, at the same time as the wording that prohibits the illegal reproduction or distribution of the issue.

In addition, this agreement gives Sacven the right to audit the phonographic producer’s workshops, stores and offices in order to check the manufacturing, record storage and other reproduction forms of sound.

Cámara Venezolana de la Industria Radiodifusora :
Over three hundred affiliated radio stations will pay to this chamber the author’s right fee for the public communication of the musical repertoire administered by SACVEN based on a percentage fee over the net annual bills that they declare before the Comisión Nacional de Telecomunicaciones.

In addition to this, the chamber compromised to make a diffusion national level campaign to make people learn about the Venezuelan legislation in relation to the author’s rights and the piracy negative effects.

DirecTV:
The contract that was signed with this satellite television company is a multi-annual one that will be in effect on July 1 this year. According to the subscribed agreement, DirecTV will pay, until December 2001, 0.030 per cent of the gross income declared every trimester to CONATEL; 0.5 per cent for the year 2002; 0.9 per cent in 2003; 1.15 per cent in 2004; and a percentage of 1.25 from the year 2005 on.

Venevision and Televen:
According to the subscribed contract, these two big television stations renewed their license to publicly communicate, reproduce and distribute Sacven’s pieces of work, to which they are obliged to pay, for the concept of author’s right, 1.05 per cent of the gross income declared to CONATEL.
In the same way, the agreement establishes that these two companies will have to mention in their regular programming that the used repertoire has been licensed by Sacven and Avinpro.

Ateneo de Caracas:
These two institutions signed an agreement on cultural cooperation to unify their efforts to defend intellectual property and, especially, author’s right.

Based on this agreement, both organizations are engaged in designing a campaign intended to inform about the legal normative that rules the author’s right subject, as well as to make people conscious about the importance that the Venezuelan authors and artists’ creative activity has in the cultural development of the country.
